By creating an account or using YieldGuard ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
These Terms form a legally binding agreement between you and the operator of YieldGuard, an individual developer based in Romania ("we", "us", "operator").
YieldGuard is a data aggregation and monitoring tool that:

You must be at least 18 years old to use the Service. By registering, you represent that you meet this requirement.
The Service is available globally. However, if your jurisdiction prohibits access to DeFi-related information services, you are responsible for compliance with local law. We make no representation that the Service is appropriate or legal in all jurisdictions.

EU right of withdrawal: Under EU Directive 2011/83/EU, you have 14 days from subscription start to withdraw and receive a full refund, provided you have not used the paid features. To exercise this right, email support@yieldguard.app.

Violation of these terms may result in immediate account termination without refund.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
Specifically, we do not warrant that:
DeFi is inherently risky. Smart contract bugs, protocol exploits, depeg events, and liquidity crises can result in total loss of funds. Past APY data does not predict future returns.
To the maximum extent permitted by applicable law, the operator shall not be liable for:
Our total liability to you for any claim shall not exceed the amount you paid to us in the 3 months preceding the claim.
This limitation does not apply to liability for death or personal injury caused by negligence, or fraud — which cannot be limited under EU law.
All content, design, code, and branding of YieldGuard is owned by the operator and protected by applicable intellectual property law. You receive a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.
APY data displayed originates from DeFiLlama (open-source) and individual DeFi protocols. We claim no ownership over third-party data.
By you: You may close your account at any time by emailing support@yieldguard.app or using the account deletion option in settings. Deletion is permanent and removes all your data within 30 days.
By us: We may suspend or terminate your account if you violate these Terms, abuse the Service, or fail to pay subscription fees. We will provide notice by email except in cases of serious abuse.
Upon termination, your right to use the Service ceases immediately. Paid subscription fees for unused periods are non-refundable except as required by EU consumer law.
We may update these Terms to reflect changes in the Service, business, or applicable law. Material changes will be communicated by email at least 14 days before they take effect.
Continued use of the Service after the effective date of updated Terms constitutes acceptance. If you do not accept the new Terms, you may close your account before they take effect.
These Terms are governed by and construed in accordance with the laws of the European Union, including GDPR and applicable EU consumer protection directives, as implemented in the member state of Romania where the operator is based.
For EU consumers, mandatory local consumer protection laws in your country of residence also apply and cannot be waived by these Terms.
Disputes shall be resolved first by good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the competent courts of the EU member state where the operator is based. EU consumers may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
